In contemporary society, the lifestyles of individuals have led to significant global transformations. Alcoholic beverages have become integral to various celebrations and festive occasions, permeating social and cultural practices. To regulate the responsible consumption of alcoholic beverages, address alcohol-related issues, and mitigate the potential damages resulting from excessive and inappropriate usage, governments have implemented and enforced laws and regulations over the course of decades. Currently, a range of legislation exists to govern and control the sale of alcoholic beverages. These include: (i) the Alcoholic Beverage Control Act B.E. 2551 (“Alcoholic Beverage Control Act”); (ii) the Excise Act B.E. 2560 (“Excise Act”); and (iii) the Mandate of the National Council for Peace and Order No. 22/2558, which encompasses measures to prevent and address problems associated with automobile and motorcycle racing, as well as the control of entertainment spots or similar venues (“NCPO No.22/2558”). Each of these laws and regulations aims to control different aspects of alcoholic beverage consumption. The Excise Act, for instance, is the current law governing excise tax on alcoholic beverages and the process of obtaining liquor licenses, encompassing restrictions on obtaining licenses and prohibiting certain areas. Moreover, NCPO No. 22/2558 extends regulations by specifying prohibited areas for the sale of alcoholic beverages and governing the operation and licensing of entertainment spots. Simultaneously, the Alcoholic Beverage Control Act plays a crucial role in regulating consumer behavior by addressing the timing and prohibited locations for alcohol sales, determining the legal drinking age, and overseeing advertisements that influence consumer decisions. Based on my research and professional experience concerning the challenges associated with alcoholic beverage control laws, I have identified a significant loophole that profoundly impacts hotel operations and their ability to provide alcoholic beverage services.

在当代社会中,个体生活方式的演变引发了全球范围内的显著变革。酒精饮品已成为各类庆典与节日场合的核心组成部分,渗透至社会与文化实践的方方面面。为规范酒精饮品的负责任饮用、应对酒精相关问题,并减轻过度与不当饮用带来的潜在危害,各国政府在数十年间陆续制定并施行了各类法律法规。当前,有多部法律法规用于监管酒精饮品的销售,具体包括:(一)《佛历2551年酒精饮品管控法案》("Alcoholic Beverage Control Act",以下简称《酒精管控法案》);(二)《佛历2560年消费税法》("Excise Act",以下简称《消费税法》);(三)《国家和平与秩序委员会(National Council for Peace and Order)第22/2558号指令》(以下简称NCPO第22/2558号指令),该指令涵盖了预防和处理机动车与摩托车竞速相关问题,以及管控娱乐场所或类似场所的相关措施。上述各部法律法规分别针对酒精饮品消费的不同维度进行管控。以《消费税法》为例,其为当前规范酒精饮品消费税及酒类经营许可申领流程的现行法律,涵盖许可申领限制及特定区域禁售条款。此外,NCPO第22/2558号指令进一步细化了监管要求,明确了酒精饮品的禁售区域,并对娱乐场所的运营与许可管理作出规范。与此同时,《酒精管控法案》则通过规范酒精售卖的时段与禁售地点、设定法定饮酒年龄,以及监管影响消费者决策的酒类广告,在规范消费行为方面发挥关键作用。结合本人针对酒精饮品管控法规相关挑战开展的研究与专业经验,本人发现了一处严重的监管漏洞,该漏洞对酒店运营及其提供酒精饮品服务的能力造成了显著影响。
