Extradition Following Convictions in Absentia: Defence Rights and Retrial Guarantees

This ARGA Observatory report examines extradition requests based on convictions delivered in the defendant’s absence. Drawing on eight cases, it analyses notice of proceedings, access to legal representation, waiver of the right to appear and the availability of a fresh determination of the charges. Particular attention is given to the content, reliability and enforceability of retrial guarantees. The report provides practical guidance on assessing the underlying proceedings and organising evidence for an extradition defence. This publication includes the Russian and English versions.
