在当下创新驱动发展的大环境中,创新主体对专利申请的重视程度日益提升,在开发主营产品的过程中,通过对产品公开的专利进行标引,开展知识产权风险尽职调查具有至关重要的意义。借助专利技术贡献度,本行业企业和技术人员,可以宏观性识别,其产品相关的各项专利,哪些是需要重点分析的高价值专利,哪些是价值度较低的低质量专利,让企业可以将有限的知识产权资源精准投入到那些更需要持续监控和关注的行业专利上。进一步地,如发生行业专利诉讼,本算法数据可以作为专利技术贡献度的计算依据,计算专利侵权赔偿数额。从长远来看,后期通过数据交易,还能有效减少行业人员的重复标引工作。公司自建有知识产权本地数据库,每件专利经企业专利工程师和研发工程师各2人,进行人工评估打分,并将评分后数据导入自建知识产权系统,存储为结果数据。人工评估打分为16个维度,包括:技术先进性、技术成熟度、技术独立性、技术可替代性、技术应用前景、权利稳定性、保护强度、不可规避性、侵权可判断性、市场当前应用情况、市场未来预期、竞争情况、政策环境、专利进攻价值、专利防御价值、专利影响力。每个维度4人打分后,取平均值并向上取整数,计入该件专利该维度实际打分值。
专利价值评分值=16个维度实际打分值*维度权重系数的求和值。(维度权重系数总和等于100%,具体分配比例见其他需要说明的信息部分)
根据国知局《2019-2023 年度专利实施许可统计表》,查询行业平均专利技术提成率,获得本行业平均提成率值。
人工确定本专利技术贡献权重值0.1~0.5:关联程度高0.4-0.5;中等0.2-0.3;低0.1
净利润分成率上限:(行业平均提成率值+5%)*本专利技术贡献权重值。
净利润分成率下限:(行业平均提成率值-5%)*本专利技术贡献权重值。
专利技术贡献度=净利润分成率下限+(净利润分成率上限-净利润分成率下限)*专利价值评分值/100。
Against the backdrop of innovation-driven development, innovation stakeholders have increasingly attached great importance to patent applications. During the development of core products, conducting intellectual property (IP) risk due diligence via indexing publicly disclosed patents related to the products is of critical significance.
By leveraging patent technology contribution rate, enterprises and technicians in the industry can macroscopically identify which patents related to their products are high-value ones requiring in-depth analysis and which are low-quality ones with limited value. This enables enterprises to precisely allocate limited IP resources to the industry patents that demand ongoing monitoring and attention.
Furthermore, in the event of industry patent litigation, this algorithm-based data can serve as the calculation basis for patent technology contribution rate, and thus help determine the amount of patent infringement compensation.
In the long run, subsequent data transactions can also effectively reduce the repetitive indexing work of industry practitioners.
The company has built its own local IP database. Each patent is manually evaluated and scored by two patent engineers and two R&D engineers of the enterprise respectively. The scored data is then imported into the self-built IP system and stored as result data.
The manual evaluation covers 16 dimensions, including: technological advancement, technological maturity, technological independence, technological substitutability, technological application prospects, right stability, protection strength, non-circumventability, infringement assessability, current market application status, future market expectations, competitive landscape, policy environment, patent offensive value, patent defensive value, and patent influence. For each dimension, after four people conduct scoring, the average value is calculated and rounded up to the nearest integer, which is recorded as the actual score of this patent for this dimension.
Patent Value Score = Sum of (Actual Score of Each of the 16 Dimensions × Dimension Weight Coefficient). (The total sum of dimension weight coefficients equals 100%; the specific allocation ratio is specified in the other explanatory information section.)
According to the "2019-2023 Annual Patent Implementation License Statistics Table" issued by the National Intellectual Property Administration (CNIPA), the industry's average patent technology royalty rate is queried to obtain the average royalty rate value of the industry.
The patent technology contribution weight value is manually determined to range from 0.1 to 0.5: high relevance corresponds to 0.4-0.5; medium relevance corresponds to 0.2-0.3; low relevance corresponds to 0.1.
Net Profit Royalty Rate Upper Limit = (Industry Average Royalty Rate Value + 5%) × Patent Technology Contribution Weight Value
Net Profit Royalty Rate Lower Limit = (Industry Average Royalty Rate Value - 5%) × Patent Technology Contribution Weight Value
Patent Technology Contribution Rate = Net Profit Royalty Rate Lower Limit + (Net Profit Royalty Rate Upper Limit - Net Profit Royalty Rate Lower Limit) × Patent Value Score / 100.
