Foreign Subsidy Measure Conclusion Named Authority List

On 12 July 2023, the Foreign Subsidies Regulation (FSR) (Regulation (EU) 2022/2560) entered into force. The FSR introduces a new set of rules that enables the Commission to address distortions caused by foreign subsidies. This allows the EU to ensure a level of playing field for all companies operating in the Single Market, while remaining open to trade and investment. This code list is about the situation of Measures applied under the Foreign Subsidies Regulation (EU) 2022/2560. Economic operators bidding in large public procurement procedures must submit a notification or declaration pursuant to Article 28(1) FSR with their tender, which is assessed by the Commission. The economic operators either provide a notification or a declaration under the FSR, depending on the amount of foreign financial contribution received. The contract award notice must acknowledge the Commission’s assessment, based on the situations described in the code list.2023年7月12日，《外国补贴条例（Foreign Subsidies Regulation, FSR）》（欧盟条例（EU）2022/2560）正式生效。该条例创设全新规则体系，赋予欧盟委员会应对外国补贴引发市场扭曲的职权，可保障欧盟单一市场内所有经营主体享有公平竞争环境，同时维持贸易与投资的对外开放性。 本代码表围绕《外国补贴条例（EU 2022/2560）》项下适用的各项措施情形展开。参与大型公共采购流程的经济经营者，须在投标时提交符合《外国补贴条例》第28条第1款要求的通知或声明，相关材料由欧盟委员会进行评估。经济经营者需根据其实际获得的外国财政资助金额，选择提交合规通知或声明。合同授予公告必须载明欧盟委员会基于本代码表所述情形作出的评估结果。
