"WE" THE UPREME: A CRITICAL ANALYSIS OF JUDICIAL ACCOUNTABILITY IN INDIA

These days there is a great hullabaloo in the power corridors of the fortress of Justice in India, we call the Supreme Court. Obviously not all things are in place and that is the reason why the skeletons have started peeping out of the graves. The situation is grim, also because of the harsh reality that the much required Judicial Reforms‘ and the long awaited‗Democratisation of the Higher Judiciary in India‘is nowhere in sight. Kudos to the Highest Interpreters of the law and proclaimed ‗Guardians of the Constitution of India‘, masses are witnessing great internal feuds of our Judiciary. Rosters of the Apex Court are being challenged in the name of high handedness and the ambiguous exercise of the discretion in formation of the Benches of the Court. In short, the doctor itself is exposed to the decease and is vehement in denying the ill. Open ended debates within the restraints of decorum are the glory of the democratic system of Governance and confer the lasting endurance to it. We have travelled a long distance of our Constitutional History. Over the times a few distortions have also crept into ourvital organs of Governance, particularly the one shouldering responsibility to ensure the sanctum sanctorum of the Constitutional Mandate. This paper is merely a sincere and modest attempt in diagnosing the melancholy and the ailment besides looking for some lasting cure.
