Pursuant to Section 56 sentence 1 of the WHG, wastewater is to be disposed of by the legal persons under public law who are obliged to do so under state law. In the state water laws, the municipalities in whose area the wastewater is generated are usually held responsible for this. Smaller local authorities (cities and agglomerations) are often combined into so-called wastewater associations. The persons obliged to dispose of waste water can use themselves in accordance with § 56 sentence 3 WHG for the fulfilment of their obligations of third parties.依据《水管理法》（Wasserhaushaltsgesetz, WHG）第56条第1款规定，污水处理义务应由依州法负有该义务的公法法人负责履行。在各州水法框架下，污水产生地的市政当局通常需承担该污水处理责任。规模较小的地方行政单位（城市与城镇集聚区）往往会联合组成所谓的污水处理协会。负有污水处理义务的主体，可自行依据《水管理法》第56条第3款的规定，代第三方履行其污水处理义务。
