In order to ensure the proper functioning of the networks, easements are established pursuant to Articles L. 57 to L.62-1 of the Post and Electronic Communications Code in order to protect radio centres against electromagnetic disturbances that may result from the operation of certain equipment, including electrical equipment. Two schemes should be distinguished: — servitudes instituted for the benefit of radio centres concerning national defence or public security (Articles L.57 to L.62 of the Postal and Electronic Communications Code); — easements established for the benefit of radio centres owned by private operators (Article L.62-1 of the Postal and Electronic Communications Code). However, in the absence of a decree implementing Article L.62-1 of the Postal and Electronic Communications Code, operators of electronic communications networks open to the public cannot benefit from radio easements to date. Servitude has the consequence of: — the obligation to stop electromagnetic disturbances: Every owner or user of an electrical installation producing or propagating disturbances that interferes with the operation of a reception centre is required to comply with the provisions indicated to him by the Minister in charge of the operation or control of the centre in order to stop the disturbance; — a prohibition, in radio protection zones, on owners or users of electrical installations to produce or propagate disturbances within the range of radio waves received by the centre and presenting for the apparatus of the centre a degree of gravity greater than the value compatible with its operation; — the prohibition, in radio guard zones, of putting into service electrical equipment capable of disrupting or modifying radio receptions without the authorisation of the Minister responsible for the operation of the centre. The generator of a public utility easement is a geographical entity whose nature or function induces, under the effect of regulation, constraints on the methods of land use of the surrounding land. The disappearance or destruction on the ground of the generator does not result in the removal of the servitude(s) associated with it. Only a new act of annulment or repeal taken by the competent authority can legally remove the effects of the easement(s) in question. Texts in force: — Articles L. 57 to L. 62-1 of the Post and Electronic Communications Code, — Article L. 5113-1 of the Defence Code, — Articles R. 27 to R. 39 of the Postal and Electronic Communications Code, — Order of 21 August 1953, as amended, on the drawing up of the list and characteristics of electrical equipment, the placing into service, modification or conversion of which is subject to prior authorisation in radio guard zones.

为保障通信网络的正常运行,依据《邮政与电子通信法典》(Postal and Electronic Communications Code)第L.57条至第L.62-1条设立地役权(easement),以保护无线电中心免受包括电气设备在内的特定设备运行所产生的电磁干扰。 需区分两类地役权情形: — 为服务于国防或公共安全的无线电中心设立的地役权(《邮政与电子通信法典》第L.57条至第L.62条); — 为私营运营商所有的无线电中心设立的地役权(《邮政与电子通信法典》第L.62-1条)。但截至目前,因尚未出台针对《邮政与电子通信法典》第L.62-1条的实施政令,面向公众开放的电子通信网络运营商仍无法享有无线电地役权相关权益。 地役权具有以下法律效力: — 停止电磁干扰的义务:任何产生或传播干扰、影响接收中心运行的电气装置的所有人或使用人,均须遵守负责该中心运营或监管的部长出具的相关要求,以消除干扰; — 无线电保护区内的禁止性规定:电气装置的所有人或使用人,不得在该中心接收的无线电波频段内产生或传播电磁干扰,且此类干扰对该中心设备造成的危害程度不得超出设备正常运行所允许的阈值; — 无线电警戒区内的禁止性规定:未经负责该中心运营的部长批准,不得启用可能干扰或改变无线电接收的电气设备。 公共事业地役权(public utility easement)的设立主体为一类地理实体,其性质或功能在监管框架下会对周边土地的使用方式施加约束。该设立主体在场地内灭失或损毁,并不会导致与之相关的地役权自动消灭。仅当主管当局作出新的撤销或废止行为时,相关地役权的法律效力才会依法终止。 现行有效法规包括: — 《邮政与电子通信法典》第L.57条至第L.62-1条; — 《国防法典》(Defence Code)第L.5113-1条; — 《邮政与电子通信法典》第R.27条至第R.39条; — 经修订的1953年8月21日法令:该法令对电气设备的清单及特性作出规定,且在无线电警戒区内,此类设备的启用、改造或改装均须事先获得批准。
