探討我國及中國大陸處罰網路智慧財產域外犯之法律依據與刑法空間效力規定之適用及競合等問題、兩岸如何務實協商網路智慧財產域外犯之刑事管轄權等爭議，最後則就兩岸合理解決智慧財產域外犯之刑事管轄權的衝突，提出符合國際立法趨勢，且利於突破現況及展望未來法制變革之芻議。

This paper investigates the issues including the application and concurrence of legal bases and spatial effect provisions of criminal law for punishing extraterritorial cyber intellectual property crimes by China's Taiwan Region and Mainland China, explores how Cross-Strait sides can conduct pragmatic consultations on disputes over criminal jurisdiction of such extraterritorial crimes, and finally puts forward tentative proposals that align with international legislative trends, help break through the current status quo, and envision future legal system reforms.
