These are areas where a significant flood risk has been identified in accordance with Section 78b of the WHG and which can be flooded with low probability [HQextrem] beyond the fixed or provisionally secured flooding area. The state of the basics used can be found in the attribute table. The situation and legal liability are derived from the data for risk areas of the HQextrem 2nd. Cycle (2019) of the Flood Risk Management Directive (HWRM-RL) as well as the current information for defined flood zones and provisional safeguards.§ 78b WHG Risk Areas outside flooding areas (version according to amendment by Flood Protection Act II)(1) Risk areas outside flooding areas are areas for which hazard maps are to be drawn up in accordance with § 74(2) and which are not defined as flood zones in accordance with Section 76(2) or paragraph 3 or are provisionally secured; this does not apply to areas that are predominantly influenced by the tides, unless otherwise specified by state law. For risk areas outside flooding areas, the following shall apply: 1. In the designation of new building areas in the outdoor area and when establishing, amending or supplementing construction plans for areas to be assessed in accordance with Section 30(1) and (2) or § 34 of the Building Code, in particular the protection of life and health and the avoidance of significant material damage must be taken into account in the weighing up in accordance with § 1(7) of the Building Code; this shall apply mutatis mutandis to articles of association pursuant to § 34(4) and § 35(6) of the Building Code;2. Outside the areas specified in point 1, construction facilities shall only be constructed or substantially expanded in accordance with the generally accepted rules of technology, adapted to the respective flood risk, insofar as such construction is technically possible according to the type and function of the installation; the construction requirements should also take due account of the location of the land concerned and the amount of possible damage.(2) Further legislation of the Länder remains unaffected.This data is also available in the INSPIRE data model “Annex 3: Areas with natural risks”. The provision is made via the Federal Institute for Water Studies (BfG) via presentation and download service, the URLs of which are specified in the transfer options.

本数据集涵盖依据《水管理法》(Wasserhaushaltsgesetz, WHG)第78b条识别出的显著洪水风险区域,即超出固定或暂定性防洪区域、且发生[HQextrem]级低概率溢流的区域。所用基础数据的详细信息可在属性表中查询。 本数据集的相关情形与法律责任,源自《洪水风险管理指令》(Flood Risk Management Directive, HWRM-RL)2019年第二轮HQextrem洪水风险区域数据集,以及已划定洪泛区和暂定性防洪加固措施的现行信息。 § 78b WHG 非洪泛区风险区域(《防洪法II》修正案修订版) (1) 非洪泛区风险区域指依据《建筑法典》(Building Code)第74条第2款需编制洪水风险图,且未依据第76条第2款、第3款被划定为洪泛区,或暂未完成防洪加固的区域;但主要受潮汐影响的区域除外,除非州法律另有规定。 针对非洪泛区风险区域,需遵循以下要求: 1. 在户外区域划定新建建筑区域,以及依据《建筑法典》第30条第1、2款或第34条需评估的区域制定、修改或补充建筑规划时,在依据《建筑法典》第1条第7款进行的利益权衡中,必须优先考虑生命与健康保护,并避免重大财产损失;该要求同样适用于依据《建筑法典》第34条第4款、第35条第6款制定的章程,可参照适用。 2. 在第1款规定区域之外,建设设施或对其进行重大扩建时,需遵循符合通用技术准则、适配对应洪水风险的标准,前提是该建设行为可根据设施的类型与功能在技术上实现;建设要求还应适当考虑相关地块的区位条件及可能发生的损失规模。 (2) 各联邦州的其他立法不受本规定影响。 本数据同样符合欧洲空间信息基础设施(INSPIRE)数据模型「附件3:自然风险区域」标准。数据由联邦水科学研究所(Bundesanstalt für Gewässerkunde, BfG)通过展示与下载服务提供,相关URL已在传输选项中列明。
