Decisões sorteadas do Tribunal de Justiça de São Paulo (2024-2025)

This research offers a critical analysis of the legislative and jurisprudential developments concerning criminal fines in Brazil, highlighting how their enforceability has disproportionately affected convicted individuals living in socioeconomic vulnerability. The changes introduced by Law No. 13,964/2019 (the Anti-Crime Package) and by the Higher Courts have substantially altered the enforcement of fines, extending the effects of criminal convictions and intensifying barriers to social reintegration. Based on an examination of recent case law from the São Paulo Court of Justice (TJSP), the study identifies progress, setbacks, and institutional obstacles in the application of criminal fines, underscoring the urgent need for reforms that incorporate socioeconomic vulnerability as a fundamental criterion to ensure rights and mitigate inequalities within the criminal justice system.
