ENSURING HUMAN RIGHTS AND PROCEDURAL GUARANTEES IN THE INVESTIGATION

This article comprehensively examines the theoretical and legal foundations of ensuring human rights and the system of procedural guarantees at the investigative stage, as well as real indicators in judicial and investigative practice. In the course of the study, international standards were analyzed, in particular, the human rights pacts adopted by the United Nations and the practice of the European Court of Human Rights. Based on judicial and investigative statistics for 2021-2024, indicators of the application of preventive measures, ensuring the right to defense, compliance with procedural deadlines, the admissibility of evidence, and complaints about torture were studied. Empirical analysis showed that, despite the existence of regulatory guarantees, some systemic problems remain in practice. As a result of the research, scientific and practical proposals were developed to strengthen the mechanisms for the real provision of human rights in investigative activities.
