DIGITALIZATION OF THE ENFORCEMENT OF COURT DECISIONS: LEGAL CHALLENGES, INTERNATIONAL PRACTICES, AND PROSPECTS FOR IMPROVEMENT

The effective enforcement of court decisions is an essential component of the rule of law and an indispensable element of access to justice. Without timely and proper execution, judicial decisions remain merely declaratory and fail to restore violated rights. In recent years, digital transformation has significantly influenced judicial systems worldwide, including enforcement proceedings. The introduction of electronic enforcement systems, artificial intelligence, and integrated digital databases has enhanced the transparency, efficiency, and accountability of enforcement authorities. This article examines the concept of digitalization in the enforcement of court decisions, analyzes international practices, identifies existing legal and procedural challenges, and proposes recommendations for improving the digital enforcement system. Particular attention is given to the role of information technologies in increasing enforcement efficiency while ensuring procedural guarantees and protecting the rights of participants in enforcement proceedings.
