Public utility easements (SUPs) are administrative limitations on the right to property, they are established for the benefit of public persons, concessionaires of public works or public works, private persons engaged in an activity in the public interest. The collection and conservation of public utility easements is a sovereign task of the State, which must bring them to the attention of local and regional authorities so that they may annex them to their urban planning documents. The public utility easements concerned are those defined by Articles L. 126-1 and R. 126-1 of the Urban Planning Code and their annexes.

PT2-type SUPs are established pursuant to Articles L. 54 to L.56-1 of the Postal and Electronic Communications Code in order to protect radio centres from physical obstacles which may hinder the spread of waves.

It is necessary to distinguish
two schemes:
easements established for the benefit of radio centres concerning national defence or public security (Articles L.54 to L.56 of the Postal and Electronic Communications Code);
easements established for the benefit of radio centres owned by private operators (Article L.56-1 of the Postal and Electronic Communications Code).

Easements established for the benefit of radio centres concerning national defence or public security shall be established by decree taken against the Minister concerned and the Minister for Industrial and Scientific Development if the ANFR gives favourable opinion; by decree of the Conseil d’État if the ANFR’s opinion is unfavourable.
The servitudes established for the benefit of radio centres owned by private operators are established by prefectural decree.

公共役权（Public utility easements, SUPs）是对财产权利的行政限制，其设立旨在服务公共主体、公共工程特许经营者、公共工程运营主体，以及从事公共利益相关活动的私人主体。公共役权的归集与保护是国家的主权性职责，国家须将相关事项告知地方与区域主管部门，以便其将公共役权纳入城市规划文件之中。本文件所涉公共役权，系《城市规划法典》第L.126-1条、第R.126-1条及其附件所定义的类型。

PT2型公共役权系依据《邮政与电子通信法典》第L.54条至第L.56-1条设立，旨在保护无线电中心免受可能阻碍电波传播的实体障碍物干扰。

须区分两类不同的设立模式：其一为服务于涉及国防或公共安全的无线电中心的公共役权（《邮政与电子通信法典》第L.54条至第L.56条）；其二为服务于私人运营商所有的无线电中心的公共役权（《邮政与电子通信法典》第L.56-1条）。

针对涉及国防或公共安全的无线电中心所设立的公共役权，若法国国家频率管理局（Agence nationale des fréquences, ANFR）出具同意意见，则由相关部长与工业与科学发展部长联合颁布法令设立；若ANFR出具反对意见，则由法国国家行政法院（Conseil d’État）颁布法令设立。

针对私人运营商所有的无线电中心所设立的公共役权，则由省长法令予以设立。
