The Law on the development plan Poppenbüttel 26 of 6 June 1986 (Hamburg Law and Ordinance Gazette page 122) is amended as follows: 1. The annexed "Annex to the Act amending the Act on the Development Plan Poppenbüttel 26" shall Law added. 2. In § 2, the following point 22 is added: "22. For the area shown in hatched form in the Annex: 22.1 The definition of "special area" for the purpose of "recreational centre" shall be converted into a general residential area; the designation "©", the line "other demarcation" and the fixed 5 m wide planting requirement for densely growing trees and shrubs are deleted. 22.2 In the general residential area, as a measure of structural use, six full storeys and one stepped storey are now permitted as a maximum, as well as a base area number of 0.3 and a floor area number of 1.2 each as a maximum. The Building Use Ordinance in the version of "23 January 1990 (Federal Law Gazette I page 133), as last amended on 22 April 1993 (Federal Law Gazette I pages 466, 479) is authoritative. Exceptions pursuant to Section 4(3) of the Building Use Ordinance are excluded. 22.3 The western construction boundary parallel to the Poppenbüttler Landstraße is shown offset by 13 m in the western direction. At a width of 20 m, the eastern section of the northern construction boundary is indicated offset by 23 m in a northerly direction and starting from this, a construction boundary is fixed on the west side and a construction line on the east side. Instead of the eastern construction boundary, a curved construction line is established, which represents a circular segment with a radius of 213 m. The apex of the circular segment lies on the newly defined construction line at a distance of 68 m from the new northern construction boundary. 22.4 In buildings on the eastern border of the general residential area, the living and sleeping rooms must be assigned to the noise-removed sides of the building by means of appropriate floor plans. Insofar as it is not possible to arrange living and sleeping rooms on the sides of the building away from noise, adequate noise protection must be provided for these rooms by means of structural measures on external doors, windows, external walls and roofs of the buildings. 22.5 parking spaces are only permitted in underground car parks. Exceptionally, above-ground parking spaces can be permitted if the living space and garden are not significantly impaired. The areas to be landscaped in underground car parks must be covered with a rootable covering of at least 50 cm. Underground car park accesses must be provided with trellises or pergolas and greened with creeping or climbing plants. 22.6 For each 500 m2 of the plot area, one large-crown or two small-crown deciduous trees must be planted. At least 30 per cent of the unbuilt land area shall be planted with shrubs and perennials." 3. Paragraph 2(2) is replaced by the following: "In the core area and on the area for public use, the building limits may be exceeded by cornices, canopies and stairwells up to 3 m." 4. Paragraph 2(3) is replaced by the following: "For the development of the general residential area, additional local traffic areas are required; their exact location is determined by the intended development. Upon request, they shall be fixed in a decision pursuant to Section 14 of the Hamburg Roads Act in the version of 22 January 1974 (Hamburg Law and Ordinance Gazette, pages 41, 83), as last amended on 4 March 1997 (Hamburg Law and Ordinance Gazette, page 35), or, in respect of certain areas, in accordance with Section 125(2) of the Building Code in the version of 8 March 1997. December 1986 (Federal Law Gazette I page 2254), as last amended on 20. December 1996 (Federal Law Gazette I pages 2049, 2076), produced." 5. In § 2(4), the words "C and" are deleted. 6. Paragraph 2(10) is replaced by the following: "In the general residential area, the maintenance requirement for trees within the buildable area is lifted. For each of these trees, three large-crowned trees must be replanted on the property. 7. Paragraph 2(18) is replaced by the following: "In the general residential area, parking spaces must be enclosed with hedges and constructed in a water- and air-permeable structure."

1986年6月6日发布的《波彭比特尔26号开发规划法案》(汉堡法律与法令公报第122页),修订如下: 1. 新增所附《<波彭比特尔26号开发规划法案>修正案附件》。 2. 在第2条中新增下述第22款: "22. 针对附件中以斜线阴影标示的区域: 22.1 将“休闲中心”用途项下“特殊区域”的定义调整为普通居住区;删除标注符号“©”、“其他分界”字样以及针对密植乔木与灌木的5米宽固定栽植要求。 22.2 在普通居住区中,作为建筑使用管控措施,现允许最高六层(含一层跃层),同时基底面积系数与容积率最高分别为0.3与1.2。以1990年1月23日(联邦法律公报第一辑第133页)版本、并经1993年4月22日(联邦法律公报第一辑第466、479页)最后一次修订的《建筑使用条例》(Building Use Ordinance)为准。《建筑使用条例》第4条第3款规定的例外情形不予适用。 22.3 与波彭比特尔兰德大街(Poppenbüttler Landstraße)平行的西侧建筑控制线,现向西偏移13米。北侧建筑控制线的东段宽20米,向北偏移23米,并以此为起点,西侧设置建筑控制线、东侧设置建筑界线。以弧形建筑界线替代原东侧建筑控制线,该弧形界线为半径213米的圆弧段,其弧顶位于新划定的建筑线上,距新北侧建筑控制线68米。 22.4 在普通居住区东侧边界的建筑内,起居室与卧室须通过合理的平面布局,布置在建筑的降噪侧。若无法将起居室与卧室布置在远离噪声的建筑侧,则须通过建筑外门、窗户、外墙与屋顶的结构构造措施,为上述房间提供充分的噪声防护。 22.5 停车位仅可设置于地下停车场。特殊情况下,若未对居住空间与花园造成显著不利影响,可允许设置地面停车位。地下停车场内需进行景观美化的区域,须铺设至少50厘米厚的可根系穿透的覆盖层。地下停车场出入口须设置格栅或藤架(pergola),并采用蔓生或攀援植物进行绿化。 22.6 每500平方米的地块面积,须种植1株大冠落叶乔木或2株小冠落叶乔木。未建设用地上至少30%的面积须种植灌木与多年生草本植物。" 3. 将第2条第2款替换为下述内容: "在核心区域与公共使用区域,檐口、雨篷与楼梯间可超出建筑控制线最多3米。" 4. 将第2条第3款替换为下述内容: "普通居住区的开发建设需增设本地交通区域,其确切位置由规划开发方案确定。根据申请,须按照1974年1月22日版本、并经1997年3月4日(汉堡法律与法令公报第35页)最后一次修订的《汉堡道路法》(Hamburg Roads Act)第14条作出决定划定其范围;或针对特定区域,按照1986年12月8日版本、并经1996年12月20日(联邦法律公报第一辑第2049、2076页)最后一次修订的《建筑法典》(Building Code)第125条第2款的规定划定。" 5. 在第2条第4款中删除“C and”字样。 6. 将第2条第10款替换为下述内容: "在普通居住区中,可建设范围内的树木养护要求予以免除。每株此类树木,须在地块内补植3株大冠乔木。" 7. 将第2条第18款替换为下述内容: "在普通居住区中,停车位须以绿篱围合,并采用透水透气的结构形式建造。"
