资源简介:
The terms of reference for the Accident Compensation Inquiry were established by the Attorney General, the Honourable F. J. Walker, Q.C., MP on 12 November 1981. Its purpose was to inquire into, report on and make recommendations concerning the extent to which compensation should be payable in respect of death or personal injury. The Inquiry was to consider: (1) whether 'no-fault compensation' should be payable in respect of death or personal injury suffered by any person through the use of a motor vehicle or other means of transport. (2) whether 'no-fault compensation' should be payable in respect of death or injury suffered by any person in circumstances other than the use of a motor vehicle or other means of transport. (3) whether a 'no-fault compensation' scheme or schemes should be introduced in New South Wales and, if so, to consider further the nature and scope of any such scheme. (4) whether any 'no-fault compensation' scheme should be in substitution for all or any rights to compensation under existing law. (5) whether the principles and practices relating to compensation for death or personal injury under workers' compensation legislation, other legislation, the tort or common law system should be modified and, if so, in what way. This series comprises 157 numbered case studies. These case studies are numbered CS1-158 (CS59 is missing), and are studies of individual accident compensation cases. These studies were collected by the Commission to allow it to obtain empirical information concerning the experiences of accident victims who received lump sum compensation payments. Included with these is a listing of case studies which gives: case study number; name of person; type of case study; compensation status; and press status. Numerical lists of the case studies are located in the front of box 12/12807. These case studies are accompanied by the following eight numbered subject folders of miscellaneous case studies and related matters: cases from newspapers (C1); cases from correspondence (C2); cases from submissions (C3); cases from judgments (C4); memos from case studies (C5); diaries of costs (C6); form letters of case study people (C7); and, cases from the Law Society (C8). (12/12807-11). 5 boxes. Note: This description is based on Concise Guide to the State Archives of New South Wales, 3rd Edition 2000.
