This work seeks to delve deeper and make some thoughts heard regarding a particularly questionable sector, that of international responsibility. That is, a sector without yet having obtained a concluded regime at the moment that each state is materially harmed and what erga omnes obligations it assumes. The aggravated regime in this sector according to the International Law Commission (ILC) has developed at the outset a mainly doctrinal debate and with the help of international jurisprudence has given light to some points of reference which show the weaknesses of the ILC to codify in the sector such as also to take an absolute and conclusive position. What are the problems related to ICL weaknesses? What are the proposed solutions? What developments have arisen in recent years in this sector? These are some of the issues that this work seeks to analyze and discuss.
