Contemporary asylum systems, rooted in the 1951 Refugee Convention’s focus on targeted persecution, struggle to address displacement driven by systemic state collapse—where failing institutions, armed non-state actors, and economic implosion leave populations unprotected. Case studies from Lebanon, Syria, Sudan, and Venezuela reveal how legal frameworks often overlook the absence of state capacity, dismissing claims that lack a singular persecutor despite life-threatening conditions. Judicial decisions in the US, Canada, and Europe frequently misinterpret realities like militia dominance or paralysed judiciaries, forcing asylum seekers into narrow legal categories ill-suited to modern crises. While complementary protections (e.g., Temporary Protected Status) exist, they remain ad hoc. A paradigm shift is urgently needed: international refugee law must expand to recognize institutional failure as a legitimate ground for protection, ensuring asylum systems align with 21st-century displacement dynamics. Without reform, systemic collapse will continue to produce protection gaps for the most vulnerable.
