Judicial decisions in the US, Canada, and Europe frequently misinterpret realities like militia dominance or paralysed judiciaries, forcing asylum seekers into narrow legal categories ill-suited to modern crises. While complementary protections (e.g., Temporary Protected Status) exist, they remain ad hoc. A paradigm shift is urgently needed: international refugee law must expand to recognize institutional failure as a legitimate ground for protection, ensuring asylum systems align with 21st-century displacement dynamics.
