VPRS 15022 Schedules of Cases, Farmers Debts Adjustment Act 1935

This series consists of schedules of cases adjusted under Section 25 of the Farmers Debts Adjustment Act. The cases relate to debts due to the Closer Settlement Commission (and later the Board of Land and Works) under the Closer Settlement Acts, Cultivation and Farmers Advances Acts, Land Acts, and the Wire Netting Act.Previously a farmer's debts to the Commission could be adjusted under provisions of the originating Act (eg. the Closer Settlement Act), but after 1935 the debts could be adjusted under the Farmers Debts Adjustment Act. Section 25(1)(a)(i) of the Act prevented the Board confirming any plan of debt adjustment which involved reduction or cancellation of debt which was already authorised to be adjusted under other Acts, unless the Governor in Council consented. Therefore, to adjust a farmer's liability in relation to certain debts, the Closer Settlement Commission (and later the Department of Crown Lands and Survey) was required to seek the consent of the Governor in Council. The Governor in Council then consented to the reduction of debts due to the Commission (or Department), providing the Farmers' Debts Adjustment Board confirmed a plan of debt adjustment.These volumes are generally labelled with Schedule of cases adjusted under the Farmers Debts Adjustment Act and the name of the Act to which the debt relates. The schedules were prepared by the Commission and the Department of Crown Lands and Survey for submission to the Governor in Council. Some have been marked by the Secretary of the Farmers' Debts Adjustment Board (eg. unit 9), indicating that the matter has been noted on the Board's files.
