VPRS 6291 Default Files (DESTROYED)

This series consists of Default Summons files from the Yallourn Courts of Petty Sessions. The Default Summons files were complaints for civil debts, which included breach of an agreement, failure of payment for goods or labour and even tax, also damages for trespass by cattle upon land. The Default Cases were held in the Yallourn Petty Sessions Court under civil jurisdiction.During each calendar year every case was allocated a sequential number according to the defendants first court appearance (Annual Single Number). If this case number referred to an earlier year the date of the year was included (eg 3/65). From this number allocated to each case in the registers, one could gain access to the case files distinguished by their particular number.The Default files list: the location and date of the hearing; case number; Complaint for a Civil Debt - date and nature of the offence; Notion of Intention to Defend - date of hearing and signature of defence certifying intention to appear in court. Sometimes included in the file are: Warrants of Distress - order for outstanding payment of costs after defendant`s conviction; Certificate of Summary Conviction or Order; Penalty for non-attendance Summons; related correspondence; other case documentation.
