According to its conception and position in the system of the Planning Act of 1949/1956, the construction plan is a preparatory construction plan for the entire area of Berlin (West). In addition to that nature, it has become binding on the individual building project as a condition of admissibility under Paragraph 7(1)-3 of the Building Code for Berlin 1958 (BO 58); in his capacity, he is transferred in accordance with Section 173(3) of the Federal Building Act (BBauG).
