Mapping of cultural monuments in Baden-Württemberg to DSchG. The cultural heritage of an object does not depend on the mapping and entry into the central monument information system ADABweb, since the list of monuments listed there does not have a constitutive (legal) nature, but merely declaratory (right-declaring) character. Objects that are not yet listed in the list of monuments can also be cultural monuments if they meet the criteria set out in § 2 DSchG BW. For a legally binding clarification, it may also be necessary in individual cases for upcoming plans or construction measures to clarify and concretise the scope of the cultural monument from a spatial and/or historical point of view. All projects therefore require early participation by the State Office for Monument Conservation in the Stuttgart Government Office and the monument protection authority responsible under § 3 DSchG BW.
