Правові засади політики розширення Європейського Союзу на схід: основа для європеїзації країн-кандидатів

Постановка проблеми. Європейський Союз є інтеграційним об’єднанням, яке залишає свої двері відкритими для нових членів, які поділяють його систему цінностей і прагнення до забезпечення миру, стабільності та процвітання. Вступ постсоціалістичних європейських країн до Європейського Союзу, спонукав ЄС до запровадження додаткових до передбачених в установчих договорах ЄС (ст. 49), спеціальних критеріїв (Копенгагенських і Мадридських). Прагнення України, поряд з іншими державами Східної і Південної Європи, увійти до складу ЄС зумовило ініціативу Європейської комісії оновити усталені критерії членства відповідно до потреб сучасного етапу європейської інтеграції. Мета статті полягає у дослідженні еволюції підходів до визначення критеріїв членства держав в Європейському Союзу крізь призму реалізації євроінтеграційних прагнень України. Методи. Для досягнення мети дослідження використано низку методів наукового пізнання. Історико-ретроспективний аналіз було використано для розкриття еволюції підходів до визначення критеріїв членства в ЄС. Використання формально-юридичного методу зумовлене потребою визначення змісту Копенгагенських і Мадридських критеріїв членства в Європейському Союзі. Метод моделювання сприяв вивченню перспектив розширення критеріїв членства на етапі вступу України до об’єднаної Європи. Результат. Встановлено, що базовими критеріями набуття членства в ЄС для всіх держав-кандидаток є географічний критерій – територіальна приналежність до Європи і політичний критерій – повага і сприйняття системи цінностей, на яких заснований Європейський Союз. Перспектива суттєвого розширення європейської інтеграції на початку 2000-х років зумовила доповнення вказаних критеріїв уточненими політичними та новими – економічним і правовим критеріями. На сучасному етапі розвитку інтеграційного процесу перед ЄС постала перспектива чергового суттєвого розширення свого складу за рахунок України, Молдови, Вірменії, а також країн Південної Європи. Це обумовлює ініціативу Європейської комісії вдатися до доповнення існуючого переліку новими критеріями членства в ЄС. Висновки. Розширення і поглиблення європейської інтеграції зумовлює вдосконалення правового виміру політики вступу до ЄС, проявом чого є доповнення базових критеріїв (політичного і географічного) додатковими критеріями, пов’язаними з особливостями певних категорій країн-кандидатів. Перспектива вступу до ЄС колишніх постсоціалістичних країн з регіонів Балтії, Східної та Південної Європи обумовило запровадження Копенгагенських та Мадридських критеріїв, які вважалися універсальними, а отже не залежали від того, яка держава буде вступати до ЄС. Перспектива вступу до ЄС України та низки інших країн стала приводом для Європейської комісії вдатися до доповнення критеріїв членства новими вимогами, які мають бути конкретизовані після виборів до Європейського парламенту в 2024 р. Problem statement. The European Union is an integration association that leaves its doors open to new members who share its system of values and commitment to peace, stability and prosperity. The aspirations of post-socialist European countries to become members and join the association necessitated the introduction of special criteria (Copenhagen and Madrid criteria). The desire of Ukraine, along with other Eastern and Southern European countries, to join the EU led to the initiative of the European Commission to update the established membership criteria to meet the needs of the current stage of European integration. The purpose of the works to study the evolution of approaches to determining the criteria for the EU membership of states through the prism of Ukraine's interests. Methods. To achieve the research goal, a number of methods of scientific cognition were used. Historical and retrospective analysis was used to reveal the evolution of approaches to defining the EU membership criteria. The use of the formal legal method is due to the need to determine the content of the Copenhagen and Madrid criteria for EU membership. The modeling method contributed to the study of the prospects for expanding the membership criteria at the stage of Ukraine's accession to the united Europe. Results. It is established that the basic criteria for EU membership for all candidate countries are the geographical criterion – territorial affiliation with Europe and the political criterion – respect and perception of the system of values on which the European Union is based. The prospect of a significant expansion of European integration in the early 2000s led to the addition of economic and legal criteria to these criteria. At the current stage of the integration process, the EU is facing the prospect of another significant expansion of its membership at the expense of Ukraine, Moldova, Armenia, and Southern European countries. This is the reason for the European Commission's initiative to supplement the existing list with new EU membership criteria. Conclusions. The expansion and deepening of European integration leads to the improvement of the EU accession policy, which is manifested in the addition of additional criteria (political and geographical) to the basic criteria related to the specifics of certain categories of candidate countries. The prospect of accession of former post-socialist countries from the Baltic, Eastern and Southern Europe led to the introduction of the Copenhagen and Madrid criteria, which were considered universal and therefore did not depend on the country joining the EU. The prospect of Ukraine and a number of other countries joining the EU has prompted the European Commission to supplement the membership criteria with new requirements to be specified after the European Parliament elections in 2024.
