VPRS 14544 Register of the Sale of Right to Lease, Sections 91 and 92 Land Act 1884 and Swamp Land Leases Section 85 Land Act 1890

This series registers the granting of leases under Sections 91 and 92 of the Land Act 1884 and Section 85 Land Act 1890. Details can include the correspondence or file number, the Section of the Act, the name of the lessees and the purpose (if under Sections 91 and 92 Land Act 1884), the town or parish where the lease was located and the area of land. Other details can include the date of the lease, when it was passed by the Governor-in-Council and sent to the Titles Office for registration and the amount of the annual rent.Section 91 of the Land Act 1884 allowed the Governor-in-Council to grant leases for no more than 21 years for no more than three acres at a rental of not less than five pounds for a variety of purposes other than pastoral or agricultural. These purposes were for industrial enterprises such as tanneries or factories or for the exploitation of resources such as quarrying. Before a lease was granted, the right to it was to be offered for sale by auction. The person who offered the highest rent was granted the right to the lease.Section 85 of the Land Act 1890 allowed the granting of twenty-one year leasesin lots of 160 acres for drained and reclaimed swamp lands. Such leases were to be granted by the Governor-in-Council and laid before Parliament. Conditions of the lease included the maintenance of all drainage facilities on the land.
