LAW AS A SCIENCE
收藏资源简介:
This article argues that law should be understood as a science and not merely as rhetoric or politics. The paper explores how Ugandan judicial reasoning reflects scientific method by drawing on jurisprudential thought from various legal scholars at the review stage of this paper. The article situates Ugandan case law within broader debates about whether law qualifies as a science and this is achieved through analysis of some recent judgments including Walakira Lawrence v Uganda (2025), Nakasi Dorcus v Nawoova Betty (2026), and Samantha Mwesigye v UCU (2026). The paper demonstrates that judicial reasoning relies on observation, deduction, and precedent. It concludes that the law when properly practiced and applied is a science of justice though vulnerable to superstition when method is abandoned.
