This series consists of the application forms for leases under the Amending Land Act 1865 which were disallowed. included are leases under Section 7 and Section 12 of the Act.Pro forma have the name, address and occupation of the applicant and details of the extent and location of the land. Some pro forma have a reason for disallowance written on them with others having the details of the relevant entry in the Government Gazette. A few pro forma have attached draft copies of leases.Section 12 of the Amending Land Act 1865 allowed persons to make application for the outright purchase or selection or for a lease of land in declared, surveyed and proclaimed agricultural areas for the purposes of residence and cultivation. The lease could be granted for a term of seven years at a rent of two shillings per acre per annum with the lease to be executed within three months of application.. Rent was to be paid half-yearly with a half-years rent in advance. The lessee was to reside upon the land for at least three years and make improvements to it. If these terms were met, after that three years, there was a right of purchase of the land at the price of one pound per acre. Allotments, as determined by the Board of Land and Works, were to be between 40 and 640 acres with no individual being able to select more than 640 acres per year.Under Section 7 of the Amending Land Act 1865, persons who had already taken leases under the Land Act 1862 under Sections 23 and 24 (agricultural lands) and Sections 33 and 34 (lands occupied under Residence and Cultivation Licences), where the transactions were incomplete or the term of the lease had not expired were allowed, under the Amending Land Act, an extension of time of twelve months to apply to the Board of Land and Works for the exercise of their right of selection or purchase.Purchasers, who had paid more than the minimum upset price of one pound per acre under the limited auction system of the Land Act 1860 were now able to lease an equivalent amount of land for eight years at a rental of two shillings and sixpence per acre provided that 320 acres was not exceeded. The Board was to issue certificates authorising the holders to select lands to be held under lease which concession the Amending Land Act 1865 extended for three months. Those persons who waived their right of selection were to be credited with the equivalent of four shillings per acre towards the purchase of Crown lands at any auction sale of Crown lands.
