VPRS 12697 Vesting Orders

The Master in Equity was responsible for the administration of the Supreme Court in Equity as well as holding various other positions. In 1883 under the Judicature Act the position of Prothonotary of the Supreme Court (VA 433) was established to relieve the Master in Equity of the administration of matters not related to Equity. The Prothonotary later assumed responsibility for the Equity functions of the Master in Equity.This series consists of the Orders made by the Supreme Court under the Statute of Trustees 1864 and its preceding Acts. These orders allowed the conveyance or assignment of lands in the control of a trustee. The Act set out a large number of circumstances in which an Order of the Court might be obtained including cases of refusal or neglect by a trustee, where the trustee had died intestate, where it was uncertain whether the trustee was living or dead, where the trustee was outside the jurisdiction of the Court or where the trustee had been declared to be a lunatic.The Vesting Orders are transcribed into the volumes. Several cases were cross checked with VPRS 259 Equity Case Files, and a copy of the Vesting Order was not in the case files that were checked.This series was formerly registered as Unit 33 of VPRS 792 Orders and decrees.
