Tinjauan Yuridis Implikasi Pemberhentian Perangkat Desa oleh Kepala Desa Dikaitkan dengan Tata Kelola Desa

The Village Head, who is also known by another name, is the party responsible for the Village
Government and is supported by Village Officials as members of the village administration. In the
Decision of the Palembang State Administrative Court Number: 254/G/2022/PTUN.PLG the object of
the dispute is the Decision of the Village Head of Paikal Lama Number 141/13/SK/PTL-KT/2022
concerning Appointment and Dismissal of Village Officials and Village Secretary of Patika Lama District
East Kikim, Lahat Regency, where the Plaintiff is a Village Official who has served for more than 3 years
as Head of Hamlet IV of Patika Lama Village. The reason in the lawsuit is that the Village Head
(Defendant) is considered to have violated the general principles of good governance, the principle of
accuracy, and the principle of transparency and violated the provisions of Article 53 paragraph (2) of
Law Number 6 of 2014 concerning Villages. According to the judge's consideration, the object of the
dispute, namely the Decree of the Village Head of Patika Lama Number 141/13/SK/PTL-KT/2022, was
declared null and void, due to procedural defects and ordered to revoke the Decree on Dismissal and
return the Plaintiff's position to its original state. This paper uses normative juridical research methods,
while the approach used is a conceptual approach. There is a deficiency in terms of a legal vacuum in
the rules for implementing the appointment and dismissal of village officials which do not clearly
regulate norms for how a village official should act in order to carry out good village governance.
