ABSTRACT:
This research paper examines the evolving landscape of fourth generation human rights in India focusing on their legal and judicial recognition through a jurisprudential lens. With rapid technological advances, biotechnological innovations and escalating environmental challenges traditional human rights frameworks require expansion to address novel concerns such as digital privacy, data protection, artificial intelligence (AI) accountability, genetic rights and climate justice. The study traces the constitutional foundations in India, the Supreme Court's landmark recognition of privacy as a fundamental right alongside legislative developments including the Information Technology Actand the Digital Personal Data Protection Act. Irrespective of these advances some challenges still remainin navigating doctrinal ambiguities, adapting laws to fast-changing technologies and balancing state interests with individual freedoms. The paper also highlights emerging dimensionslikeAI rights and the intersectionality of marginalized communitiesand discusses issues in implementation such as the digital divide and socio-economic disparities.
