1.依据用途:一是根据《关于印发〈福建省用人单位工资支付行为守信激励和失信惩戒暂行规定〉的通知》(闽人社文〔2016〕374号)规定,各级人社行政部门按照劳动保障监察管辖范围,每年3月对辖区内企业开展一年一次信用等级评价,评价等级划分为守信、一般失信、严重失信三级,归入诚信档案,至少保留3年。对评为守信的用人单位给予奖励,对评为一般失信、严重失信的用人单位予以失信惩戒。 二是根据《福建省人力资源和社会保障厅关于宣布废止和失效一批行政规范性文件的通知》(闽人社发〔2022〕2号)规定,于2022年10月31日起废止《关于印发〈福建省用人单位工资支付行为守信激励和失信惩戒暂行规定〉的通知》(闽人社文〔2016〕374号)。故而,从2023年1月1日起将不再组织全省开展上年度用人单位工资支付行为等级评价工作。2.数据内容(9项):用人单位全称、统一社会信用代码(或者注册号)、地址、法定代表人或者负责人姓名、评价依据、评价结果、评价时间。
1. Regulatory Basis and Implementation Arrangement:
1.1 Pursuant to the Notice on Issuing the Interim Provisions on Incentive for Trustworthiness and Punishment for Untrustworthiness in Wage Payment Behavior of Employers in Fujian Province (Minrenshe Wen [2016] No. 374), human resources and social security administrative departments at all levels shall carry out annual credit rating assessments on enterprises within their respective jurisdictions in March each year based on the labor security supervision jurisdiction scope. The assessment grades are divided into three levels: trustworthy, generally untrustworthy, and seriously untrustworthy, which shall be recorded in the integrity archives and retained for at least 3 years. Employers rated as trustworthy will be granted incentives, while those rated as generally untrustworthy or seriously untrustworthy will be subject to untrustworthiness-related penalties.
1.2 Pursuant to the Notice of Fujian Provincial Department of Human Resources and Social Security on Announcing the Abolition and Invalidation of a Batch of Administrative Normative Documents (Minrenshe Fa [2022] No. 2), the aforementioned Notice on Issuing the Interim Provisions on Incentive for Trustworthiness and Punishment for Untrustworthiness in Wage Payment Behavior of Employers in Fujian Province (Minrenshe Wen [2016] No. 374) shall be abolished as of October 31, 2022. Accordingly, the organization of annual wage payment behavior rating assessment for employers across Fujian Province will be discontinued starting from January 1, 2023.
