The essay reconstructs the jurisdictional policy that, in the Modern Age, the central authorities of the Kingdom of Naples adopted to oppose the «ancient and immemorial» custom (widespread in France, England and Spain) of the so-called testaments of the soul, imposed by some bishops of the Kingdom on the assets of the ab intestato dead, committing a series of abuses (refusal of the celebration of masses for the souls and of the christian burial) to prejudice of the dead and of the heirs who didn’t accept the bishop’s requests, sometimes very onerous.

Il saggio ricostruisce le politiche giurisdizionali che, in età moderna, le autorità centrali del Regno di Napoli adottarono per contrastare la consuetudine «antica e immemorabile» (diffusa anche in Francia, Inghilterra e Spagna) dei cosiddetti testamenti dell’anima, imposti da alcuni vescovi del Regno sui beni dei morti ab intestato, commettendo una serie di abusi (rifiuto della celebrazione di messe di suffragio e della sepoltura ecclesiastica) a danno dei defunti e degli eredi che non accettavano le richieste vescovili, talvolta assai onerose.
