Are there customary rules in the area of unilateral sanctions?
收藏资源简介:
The practice of unilateral sanctions in recent years and especially extraterritorial ones is a topic of greater discussion and passion among scholars of international law. As a harbinger, the work of the International Law Commission (ILC) and the first results in the sector from the conclusions of 2018 allowed us to make hypotheses on the subject and open the way to various questionable theories always based on the principles of international law. Of course the time is ripe for various statements but perhaps it is not yet the time to talk about a concrete rule that has to do with international custom in the sector. There are many problems and especially political dynamics in the sector which do not yet allow us to reach concrete conclusions. The period of multilateralism as it was understood in the past is now over. But now we need more concrete rules that are part of today's transformed society which is that of the international community as a whole. But is all this possible? We will know in the future and that will also be the challenge of the ILC in its work in the coming years.
