Cross-Border Data, Compliance Screening and Procedural Safeguards: A Structural Risk Assessment for the Digital Economy and Financial Integration in Latin America

This independent analytical report examines structural risks arising from cross-border data flows and automated compliance screening within Latin America’s digital and financial ecosystems. As financial institutions, fintech platforms, and digital commerce increasingly rely on integrated data infrastructures — including sanctions lists, adverse media, judicial records, and private compliance databases — the quality, accuracy, and correctability of such data have become decisive factors for financial access and institutional trust. The report analyzes the growing mismatch between the speed of global risk-signal propagation and the slower mechanisms available for correcting erroneous, outdated, or contextually distorted information. Particular attention is given to data contamination, persistence of obsolete records, and algorithmic amplification of negative signals that may produce long-term reputational traces affecting banking access, cross-border payments, investment flows, and participation in digital markets.
