Life After Deletion of INTERPOL Data: National Records, SIS and Legal Remedies
收藏资源简介:
Deletion of INTERPOL data does not automatically determine the status of information held in national police files or other law enforcement systems. This report examines the legal and practical consequences of deletion, focusing on national records, the Schengen Information System (SIS) and selected Europol procedures. It distinguishes outdated reproductions of an international wanted status, independent national measures, historical records and cases of mistaken identity, with France and Germany providing specific examples of routes to legal protection. The analysis considers how a CCF decision or confirmation of deletion can support requests for access, rectification, erasure or restriction of processing under the applicable framework. It also examines the difference between notifying national authorities and establishing that corrections have actually been implemented. Its central concern is identifying the particular record, responsible authority and available remedy without treating deletion as the cancellation of every associated criminal, border or immigration measure.
