The essay aims to identify the time from which stuprum per vim (heterosexual and homoerotic) was submitted to the legislation on violence: to this purpose, the punitive profile and prescriptive regime of the case are relevant on the one hand, and the relationship between intent and violence on the other. It is also proposed to clarify whether the ascription to the vis legislation was due to the type of conduct or 'quoad poenam'.
