Будівельне право: деякі методологічні підходи до сфери правової дійсності, яка формується

The article examines construction law as a field in which law must actively shape the built environment, rather than merely respond to technical regulation and market forces. It presents construction law as an interdisciplinary, structurally complex branch that connects public, private, financial, environmental, planning, and contractual regulation throughout the life cycle of a construction project, highlighting that various legal regimes intersect on the construction site. The author advocates a systemic doctrinal framework of “construction law” that moves beyond the fragmented treatment of permits, contracts, and property issues, instead viewing construction as a unified process requiring coherent legal instruments, clear risk allocation, and refined categories such as “investment-building activity” and “legal regime of the construction object.”
