Public Access Point Locations in New Jersey

The public's right to access tidal waters and their shorelines is a concept that existed prior to the inception of the State of New Jersey and continues to this day. Public access is a right expressed in the Public Trust Doctrine, in the many court cases that have interpreted and implemented its strictures, and implicitly in the many legislative acts and regulatory provisions that have sought to protect and enhance access. The Department of Environmental Protection has long seen protecting this right as a vital part of our mission, and we require public access to the shore and tidal waterways under the Coastal Zone Management rules. Staff works with municipal governments to develop voluntary Municipal Public Access Plans consistent with the Coastal Permit Program (N.J.A.C. 7:7) and Coastal Zone Management rules (N.J.A.C. 7:7E) in an effort develop Municipal Public Access Plans to enhance public access to tidal waters in a comprehensive manner. These plans consist of an inventory of existing public access amenities within a municipality, along with a needs assessment, and a list of planned enhancements or expansions of public access facilities in accordance with State criteria. This layer represents an inventory of potential public access points have been identified in MPAPs or have visual or other access to tidal waterbodies using best available data. As additional public access plans and inventories are developed this layer will be updated.公众使用潮汐水域及其岸线的权利，是新泽西州建州前便已存在且延续至今的一项理念。公众通行权是公共信托原则（Public Trust Doctrine）的明确体现，既得到诸多阐释与落实该原则约束性条款的司法判例的支撑，也隐含在众多旨在保护与优化通行权的立法法案与监管条款之中。新泽西州环境保护部长期以来将保护该项权利视为自身使命的核心组成部分，并依据《海岸带管理规则》要求保障公众对海岸与潮汐水道的通行权。该部门工作人员与各市政当局合作，制定自愿性的《市政公共通行计划》（Municipal Public Access Plans），该计划需符合《海岸许可计划》（Coastal Permit Program，N.J.A.C. 7:7）与《海岸带管理规则》（Coastal Zone Management rules，N.J.A.C. 7:7E），以期全面优化公众对潮汐水域的通行条件。此类计划涵盖对辖区内现有公共通行设施的清单梳理、需求评估，以及符合州级标准的公共通行设施优化或扩建计划列表。本数据集图层基于现有最优数据，梳理了两类潜在公共通行点位：一是已在《市政公共通行计划》（MPAPs）中确认的点位，二是可通过视觉或其他方式抵达潮汐水体的点位。随着后续更多公共通行计划与清单的制定完成，本图层将同步更新。
