Reform of the CCF Statute: Reasoned Decisions and Confidentiality

This report examines the relationship between reasoned decisions and confidentiality in proceedings before the Commission for the Control of INTERPOL's Files (CCF). Drawing on the CCF Statute, its Operating Rules, published decision excerpts and comparative European human rights case law, it analyses how applicants and data sources can understand the grounds for a decision when access to relevant information is restricted. Particular attention is given to Articles 35, 38 and 42 and the connection between adequate reasons and applications for revision. The analysis explores a model combining a complete internal decision with versions adapted for different recipients. It addresses safe summaries, indirect identification risks, scrutiny of withheld material and consistency between communicated reasons and outcomes. The report distinguishes existing legal requirements from proposed reforms and identifies the limits of conclusions drawn from anonymised published decisions.
