REKONSTRUKSI ELEKTRONIK DALAM HUKUM ACARA PIDANA INDONESIA: TANTANGAN DAN LEGALITAS ALAT BUKTI KONTEMPORER

The rapid development of digital technology challenges the conventional paradigms of the Indonesian Criminal Procedure Code (KUHAP). This study examines the legality and challenges of implementing digital audio-visual technology in electronic crime scene reconstructions within the Indonesian criminal justice system. Using a normative legal research method with statutory and conceptual approaches, this paper analyzes how electronic reconstructions align with legal principles of directness (asas langsung) and the formal requirements of digital evidence. The results indicate that while electronic reconstruction significantly enhances the efficiency and accuracy of demonstrating the locus and tempus delicti, its position within the framework of article 184 of the KUHAP remains ambiguous. It functions primarily as an extension of letters (surat) or electronic instructions (petunjuk), provided it satisfies the integrity mechanisms under the Electronic Information and Transactions (ITE) Law. This study concludes that a specialized framework is urgently needed in the upcoming revision of the KUHAP to guarantee the admissibility and standards of digital-based investigative acts.
