In law, citizens cannot be discriminated against based on their sexual orientation. A YES score is earned where the law guarantees citizens: 1) the right to protection from discrimination based on sexual orientation, 2) the freedom to exercise any sexual orientation, and 3) the right to manifest and exercise his/her sexual orientation in public or private, individually or as a group. A general constitutional principle against discrimination is NOT enough to score YES. A NO score is earned where such laws don't exist. It also scores NO if a law forbids homosexuality.
