Re-engaging with concerns over latent design invalidity: examination and invalidation of registered Community designs at the EUIPO (Edward Elgar Research Handbook chapter)

This dataset accompanies the chapter: J Cornwell, 'Re-engaging with concerns over latent design invalidity: examination and invalidation of registered Community designs at the EUIPO' in E Derclaye (ed) Research Handbook on Empirical Studies in Intellectual Property Law (Edward Elgar, 2023). The dataset covers a sample of EUIPO Invalidity Division decisions published in English in which the contested RCD was invalidated over the 10-year period from 2011-2020. Data includes: the ground of invalidity upon which the contested RCD was invalidated; for all invalidations based on lack of novelty or individual character, whether the invalidating prior art relied upon by the Invalidity Division included some kind of IP filing; and for each such IP filing, data on its type (e.g. whether an earlier design, trade mark, patent or utility model), jurisdiction, and whether its classification matched or was equivalent to the Locarno classification of the contested RCD.
