Sites not subject to the remediation procedure

The Provincial Environmental Protection Agency manages the register of sites subject to the remediation procedure referred to in Article 251 of Legislative Decree No 152/06, as also provided for in Article 77bis(10ter) of the TULP (Presidential Decree No 1-41/Leg of 26 January 1988). Other types of sites have also been included in the register and should be tracked for planning and land use purposes. The “SITES NOT SUBJECT TO TRANSFER PROCEDURE” of interest for planning and land use purposes are: - Former reclaimed SOIS landfills (ref. Article 76 of the DPGP No 1-41/Leg. of 26 January 1987) represent the old municipal solid waste landfills used locally before the activation of the controlled landfills. They are represented in the register with the reference cadastral parcels, which generally cover a much larger area than was actually the subject of the waste disposal activity in the past. They are currently being reclassified by the Provincial Purification Agency – Plant Management Service, to which reference should be made for the exact extent and location of the previous waste management activity. - Under Article 77(1) of the TULP: they represent old uncontrolled landfills of waste subject to safety measures pursuant to Article 77 of DPGP No 1-41/Leg of 26 January 1987 – Natural Fund: areas where, on the basis of specific surveys, the presence of exceedances of the contamination threshold concentrations due to natural causes has been recognised.
