КОНСТРУКЦІЇ МАЙНА, ВІДОКРЕМЛЕНОГО З ПЕВНОЮ ПРАВОВОЮ МЕТОЮ
收藏资源简介:
The article examines the civil‑law concept of assets separated for a specific legal purpose and argues for a more precise understanding of “property” as a legal object rather than a merely material category. It reconstructs the notion of “patrimonial mass” as a dynamic set of rights (assets) and obligations (liabilities) attached to a person, then analyses when and how parts of this mass may be functionally segregated without full personification (e.g. inheritance, enterprise, special funds). Using comparative examples (Netherlands, Germany, France, Ukraine), the author shows that the goal of separation determines the applicable legal regime and that incoherent fictions (such as treating an enterprise as immovable) distort the circulation of assets, whereas conceptually consistent models better reconcile turnover, asset protection, and creditor interests.
