INTERPOL Silver Notices: International Asset Tracing and the Legal Limits of Cross-Border Property Measures

This study examines the emerging INTERPOL Silver Notice and Silver Diffusion framework as a new instrument for the international tracing of assets connected to criminal activity. It analyses the legal nature of Silver Notices, their place within the existing international asset recovery architecture, and their relationship with mutual legal assistance, financial intelligence, banking compliance, data protection, and national freezing and confiscation procedures. Particular attention is given to the gap between the formally non-binding nature of a Silver Notice and its potentially coercive practical consequences. The study considers the risks of account restrictions, asset immobilisation, reputational harm, and adverse measures affecting bona fide third parties without an independent judicial determination. It evaluates these risks against the requirements of property protection, the presumption of innocence, due process, effective remedies, proportionality, and personal data protection. The study also introduces the concept of the “ARGA effect”: a self-reinforcing cascade in which an initial international police signal may be treated by national authorities, financial institutions, registries, and courts as independent confirmation of the same underlying allegation. Drawing on international conventions, European law, INTERPOL rules, comparative jurisdictional analysis, and asset recovery practice, the study proposes safeguards for distinguishing asset tracing from freezing and confiscation. It concludes with recommendations for INTERPOL, national authorities, financial institutions, and affected asset owners, as well as possible development scenarios for the Silver Notice system through 2028.
