LEGAL FOUNDATIONS FOR ENSURING THE PRINCIPLES OF JUSTICE AND HUMANITY IN CRIMINAL SENTENCING

This article systematically examines the constitutional, criminal law, and international legal foundations for ensuring the principles of justice and humanity in criminal sentencing. The study aims to determine the interrelationship between these principles within the sentencing process, evaluate their significance in judicial practice, and develop scientifically grounded proposals for improving the mechanism of individualized sentencing. Furthermore, the study substantiates the necessity of strengthening proportionality standards in sentencing, enhancing judicial reasoning concerning the necessity and sufficiency of imposed sanctions, and promoting a human rights-oriented sentencing policy.
