The Organic Theory of the Corporation: Social Groups and Their Recognition in Law

Human beings are moral agents, capable of doing wrong and right. But – if a human being is to be held legally accountable for their wrongs, or able to legally enforce their rights, they need to have their personalities recognised by the law. This thesis argues the same thing is true for social groups. Entities like churches, clubs, governments and businesses are moral agents that need legal personalities to be held responsible for their wrongs and able to enforce their rights. This argument forms the basis for the various conclusions this thesis draws regarding the rights and duties of corporations.
