VPRS 14566 Dec Com Book (Commissioners nominated for taking Declarations)

It consists of citizens of 'good standing' residing within Victoria, requesting an appointment as a commissioner for taking declarations and affidavits.The application was made to the Governor in Council, following nomination by a respected official such as a Member of Parliament. The report was forwarded to the Stipendiary Magistrate of the local/regional court for approval, prior to the appointment. Appointments of successful applications were published in the Government Gazette.Commissioners were appointed according to the provisions of Division 8 of part IV ss 111 - 114 of the Evidence Act 1928. 'All affidavits to be used for any purpose (except in any proceeding in the Supreme Court) may be sworn before a commissioner for taking declarations and affidavits, who is hereby authorised to take and receive same.'They were not Commissioners of the Supreme Court for taking affidavits.For register of persons appointed as Commissioners for taking declarations and affidavits, refer to VPRS 7746.
