The Regulation on the Stellingen Development Plan 49
of 3 September 1998 (HmbGVBl. p. 199) is replaced by the following:
amended:
1. The annexed "Annex to the Ordinance amending the Ordinance on the Stellingen Development Plan 49" is added to the Ordinance.
2. In the drawings of the zoning plan Stellingen 49, the definition of the closed construction method and the designation "(A)" are deleted in the industrial area. The fixing of a building height of 12 m to 14 m as minimum and maximum dimensions is changed to a building height of 14 m as maximum dimensions.
3. Paragraph 2 is amended as follows:
3.1 Point 1 is amended as follows:
3.1.1 the first sentence is replaced by the following:
"In the industrial area, air-polluting and odour-polluting establishments as defined in column 1 of the Regulation on installations requiring approval (4. BImSchV) in the version of 14 March 1997 (BGBl. I p. 505), as last amended on 15 July 2006 (BGBl. I p. 1619, 1623), inadmissible."
3.1.2 The following sentences are added:
"Noisy establishments and installations shall be permitted in the industrial area if the requirements laid down in point 6.1, first sentence, point (e), are complied with in the residential areas adjacent to the east, taking into account point 3.2 and in particular point 3.2.1 of the Technical Instructions for Protection against Noise (TA Lärm) of 26 August 1998. Exceptions for places of entertainment shall be excluded."
3.2 Points 2 and 3 are deleted.
3.3 The previous points 4 to 8 become points 2 to 6.
3.4 The following point 7 is added:
"7. For compensatory measures, the industrial area is allocated a sub-area of approximately 4860 m2 of parcel 4351 of the Stellingen district outside the planned area.
