Supporting data for “International Intellectual Property Arbitrability: Legitimacy and Regional Coordination from a Hong Kong Perspective”

The Survey aims to research the outlook of the IP arbitrability issues arising in international commercial arbitration. In this study, the questionnaire is dedicated to assembling expert opinions on the legitimacy issue in international IP arbitration and evaluating the efficacy and effectiveness of Hong Kong’s arbitration law reform.The questionnaire was distributed among a targeted group of arbitration professionals, including legal scholars, researchers, policymakers, institutional staff, and counsels actively engaged in intellectual property dispute resolution. Participants were selected based on their familiarity with cross-border legal practices and their professional experience with arbitration laws.A combined distribution method was adopted: offline dissemination was conducted at key events organized by arbitration institutions, while online distribution was conducted via LinkedIn by screening professional profiles and sending targeted invitations, and was further supported by networks of scholars and IP-specialized legal practitioners, as well as respondent referrals and reposts. In total, 59 responses were collected: 34 from the English-language survey and 25 from the Chinese version.Survey results demonstrate strong professional recognition of the 2017 amendment, which is widely regarded as clarifying IP arbitrability, enhancing Hong Kong’s competitiveness as an arbitral seat, and increasing confidence in the reliability of Hong Kong-seated awards.
