Compensation areas in North Rhine-Westphalia

According to Section 15(2) of the Federal Nature Conservation Act, the polluter is obliged to compensate or replace unavoidable damage to nature and landscape with measures of nature conservation and landscape maintenance. An impairment is replaced if and as soon as the impaired functions of the natural balance in the affected natural space are manufactured in an equivalent way and the landscape is redesigned according to the landscape. On the basis of the main natural units, for NRW natural spaces are excluded as so-called compensation areas in which there is a natural connection between intervention and use.
