DEFINITENESS AND INDEFINITENESS IN ENGLISH LEGAL DISCOURSE

This article studies definiteness and indefiniteness in English legal discourse. In English, we show definiteness with words like "the," "this," or "that." We show indefiniteness with words like "a," "an," or "any." In everyday English, these words are usually easy to understand. But in legal English, they are very important, because a small change can change the meaning of a law or a contract. This study looks at real legal texts, such as contracts, statutes, and court documents. It finds that legal English uses definite forms to talk about things that were already named before, and indefinite forms to talk about general rules or unknown cases. The study also finds that legal writers sometimes avoid articles completely, or use unusual patterns, to make the text more precise and to stop different readings of the same sentence. These findings are useful for legal translators, law students, and people who teach legal English.
